PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE BOOKING.
These Terms and Conditions (“Terms”) form a legally binding agreement between you (“Participant”) and Boss Lady Academy Pty Ltd and The Retreat Specialists Pty Ltd (together, “we”, “us”, “our”, the “Organisers”). By completing your booking, you confirm that you have read, understood, and agree to be bound by these Terms in full.
These Terms are governed by the laws of New South Wales, Australia. Nothing in these Terms excludes, restricts, or modifies any rights you hold under the Australian Consumer Law (“ACL”) that cannot lawfully be excluded.
Where you select YES to having read these Terms on the Registration and Checkout Form, we take no responsibility if you have not fully read and understood them.

2. BOOKING & PAYMENT
2.1 To secure your place, a non-refundable deposit of $500 AUD is required at the time of booking. Payment of the deposit constitutes your acceptance of these Terms.
2.2 The full remaining balance must be paid no later than 6th June 2026
2.3 If you select a payment plan, monthly instalments will be automatically debited from the date of your deposit. All payments must be finalised by 6th June 2026, regardless of plan selected.
2.4 All prices are quoted in Australian Dollars (AUD). Any applicable credit card surcharges will be disclosed at checkout.
2.5 Your place is not confirmed until your deposit has been received and you have received written confirmation from the Organisers.
2.6 Both co-organising entities are party to this agreement. Payments may be directed to either Boss Lady Academy Pty Ltd or The Retreat Specialists Pty Ltd as advised at the time of booking.
3. CANCELLATION POLICY

Cancellation Timing - Refund Outcome
More than 90 days before retreat start - 50% refund of total fees paid less $500 non-refundable deposit
90 days or fewer before retreat start - No refund
3.1 The $500 AUD deposit is non-refundable in all circumstances. It may, at the Organisers’ discretion, be applied as a credit toward another Boss Lady Academy or The Retreat Specialists program or event.
3.2 If you wish to transfer your place to another eligible participant, this must be arranged no later than 30 days before the retreat start date and will incur a $50 AUD administration fee. The substitute participant must complete all required registration documentation.
3.3 Cancellation fees reflect genuine pre-committed costs to third-party suppliers including accommodation, meals, activities, and facilitators, as required by the ACL.
3.4 We strongly recommend you purchase comprehensive travel insurance with cancellation cover at the time of booking to protect against unforeseen personal circumstances.
If We Cancel
3.5 If the Organisers cancel the retreat, you will receive a full refund of all monies paid within 60 days of written notification. The Organisers will not be liable for any additional costs you may have incurred, including flights, visas, or other travel expenses — this is why travel insurance is strongly recommended.
3.6 If the retreat is cancelled or postponed due to circumstances beyond our reasonable control (including but not limited to natural disaster, pandemic, government travel restrictions, or force majeure events), the Organisers will endeavour to offer a rescheduled date. If you are unable to attend the rescheduled date, a full refund of monies paid will be provided. The Organisers will not be liable for additional consequential costs.
4. PROGRAM ALTERATIONS
4.1 The Organisers reserve the right to make reasonable changes to the retreat itinerary, schedule, facilitators, accommodation, or activities where circumstances require it. You will be notified of any significant changes as soon as practicably possible via email.
4.2 Where a significant change materially alters the nature of the retreat, you will be offered a choice of credit, transfer, or pro-rata refund, consistent with your rights under the ACL.
4.3 Where the specified accommodation becomes unavailable, the Organisers will endeavour to source alternative accommodation of equivalent or superior standard.
5. TRAVEL INSURANCE (MANDATORY RECOMMENDATION)
5.1 Travel and health insurance is not included in the retreat fee. It is the Participant’s sole responsibility to arrange comprehensive travel insurance prior to departure, covering cancellation, medical treatment and evacuation, loss of luggage, and personal liability.
5.2 We strongly recommend purchasing travel cancellation insurance within 10 days of your booking being confirmed to maximise your coverage.
5.3 The Organisers are not responsible for any costs, losses, or damages arising from your failure to obtain adequate insurance.
6. PARTICIPANT RESPONSIBILITIES & CONDUCT
6.1 By booking, you confirm that you are in good physical and mental health and are able to participate in retreat activities. If you have any medical conditions, disabilities, dietary requirements, or other relevant personal circumstances, you must disclose these to the Organisers prior to booking.
6.2 You are responsible for ensuring your passport is valid for at least 6 months beyond your intended travel dates, and for arranging any required visas, vaccinations, or entry documentation for Indonesia.
6.3 All participants are expected to treat fellow participants, facilitators, venue staff, and the broader community with respect. The Organisers reserve the right to remove any participant whose conduct is deemed disruptive, harmful, unsafe, or contrary to the values of Built By HER™, without refund.
6.4 You are responsible for any damage caused to accommodation, equipment, or facilities during the retreat. Costs for damage will be assessed by the relevant provider and coordinated through the Organisers.
7. INCLUSIONS & EXCLUSIONS

Not Included
• International and domestic flights
• Travel and health insurance (strongly recommended — see Section 5)
• Visa fees and related documentation costs
• Personal spending, shopping, or additional excursions outside the program
• Alcoholic beverages (unless specified in the itinerary)
• Any medical, pharmaceutical, or emergency costs
• Airport transfers outside of the specified arrival and departure days
8. PHOTOGRAPHY & INTELLECTUAL PROPERTY
8.1 By attending the retreat, you consent to photographs and video being taken during the event in which you may appear. These may be used by Boss Lady Academy Pty Ltd and The Retreat Specialists Pty Ltd for promotional purposes including social media, websites, and marketing materials, without further consent or compensation.
8.2 If you do not wish to be photographed or filmed, please notify the Organisers in writing prior to the retreat start date.
8.3 All retreat content, frameworks, methodologies, materials, and intellectual property presented during Built By HER™ remain the sole property of Boss Lady Academy Pty Ltd and/or The Retreat Specialists Pty Ltd and/or the relevant facilitators. You may not reproduce, share, distribute, or commercialise any materials without prior written consent.
9. PRIVACY
9.1 The Organisers collect and handle your personal information in accordance with the Australian Privacy Act 1988 (Cth) and our respective Privacy Policies, available at [michellefragias.com] and [theretreatspecialists.com].
9.2 Your information will not be shared with third parties except where necessary to deliver the retreat (for example, accommodation providers, transport operators, or activity facilitators).
10. LIMITATION OF LIABILITY
10.1 To the fullest extent permitted by law, the Organisers, their respective directors, facilitators, employees, and contractors accept no liability for:
• Personal injury, illness, death, or loss or damage to property
• Loss or delay of baggage
• Delays, inconvenience, or loss of enjoyment arising from circumstances beyond the Organisers’ reasonable control.
• The acts, omissions, or negligence of third-party suppliers including accommodation providers, transport operators, or activity facilitators.
• Any business, financial, life, or legal advice received or acted upon during the retreat.
10.2 Participation in all retreat activities, accommodation, transport, and excursions is entirely voluntary and at the Participant’s own risk.
10.3 Nothing in these Terms excludes any guarantee, condition, or warranty implied by the ACL that cannot be excluded by law. Where the ACL applies and liability cannot be excluded, our liability is limited to resupply of the services or payment of the cost of resupply, whichever we elect.
11. WARNING UNDER THE AUSTRALIAN CONSUMER LAW
WARNING UNDER THE AUSTRALIAN CONSUMER LAW
Under the Australian Consumer Law, several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named in this agreement is required to ensure that the recreational services it supplies to you are rendered with due care and skill and are reasonably fit for any purpose which you make known to the supplier
Under section 139A of the Competition and Consumer Act 2010, the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you. If you sign this agreement, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law are excluded, restricted, or modified in the way set out in this document.
IMPORTANT: This agreement does NOT exclude your right to sue the supplier if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” means acting or failing to act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See section 22(3)(b) of the relevant state legislation.
12. DISPUTE RESOLUTION
12.1 If a dispute arises, we ask that you contact us first in writing at michelle@michellefragias.com and or admin@ultimategirlsweekaway.com so that we can attempt to resolve it promptly and in good faith.
12.2 If the matter is not resolved within 14 days of written notice, either party may seek mediation or pursue resolution through the courts of New South Wales, Australia.
13. GENERAL
13.1 These Terms constitute the entire agreement between the Participant and the Organisers in relation to the Built By HER™ retreat.
13.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
13.3 The Organisers reserve the right to update these Terms from time to time. The version in effect at the time of your booking applies to your participation. Any material updates will be communicated by email with a minimum of 14 days’ notice.
13.4 These Terms are governed by the laws of New South Wales, Australia, and both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
